There are a range of different injuries that call for total & permanent disability claims.

A total and permanent disability claim usually follows a severe injury or a prolonged illness. These claims are for injuries and illnesses that prevent us from being able to work. Eye injuries, back and spinal injuries, brain injuries, disability, and anxiety and depression are all examples of TPD claims.

Remember, strict time limits apply, so it’s important to get in touch for your free initial consultation as soon as you can.

So, how does a total & permanent disability claim work?

A TPD claim is usually received as a lump sum payment following a severe injury or prolonged illness that prevents your ability to return to work. Claimants usually access these payments through their superannuation, with the support of a compensation lawyer.

These claims are pretty complex and depend on a few factors, including your superannuation fund, your employment history, and the level of disability or injury sustained.

Have a Question?

Making a total and permanent disability claim is a daunting process. We know that often in legal cases, it’s the unknown that’s the scary part. Below are a few of our most frequently asked questions.

There are a variety of different injuries you can claim for, both physical and psychological:

  • Brain Injuries
  • Head & Neck Injuries
  • Back, Shoulder & Spinal Injuries
  • Eye Injuries
  • Anxiety & Depression

While total and permanent disability claims are related to an insurance policy in your superannuation, these aren’t so straightforward. Unfortunately, it’s not at all the same as accessing a typical insurance claim.

Different superannuation policies will hold different levels of TPD cover and accessing these benefits can be tricky.

We highly recommend reaching out to our friendly lawyers who can support you through the process. Partnering with a lawyer will typically speed the process up and give you a better chance of a successful claim.

There are a few different factors that will determine whether you can make a TPD claim:

•    Level of Disability – To make a TPD claim, you will likely need to show that you are suffering a minimum level of disability that affects your ability to return to your employment.

•    Employment history – Your superannuation funds’ TPD policy may require you to satisfy a minimum level of employment (i.e. weekly working hours) before you can make a TPD claim.

•    Superannuation fund – Each superannuation fund is different. Therefore, before you lodge a TPD claim you will need to find out whether TPD cover is included in your policy. We can help you with this.

•    Waiting periods – Most policies will generally have waiting periods in place. This is so your injuries and symptoms can stabilise before you can make a TPD claim. The waiting period typically starts from the date you suffered an injury.

If you’re still not sure, we recommend booking a free consultation with our team.

Each claim is different, so we can’t put a definitive timeframe on these.

There is typically a waiting period allowed for your injuries to stabilise — but these periods vary with the policy.

There will also be some time required to collect evidence surrounding your medical history.

In some circumstances, claims can be done and dusted within three months, others can last more than a year.

In your initial consultation, we’ll run through these factors and give you a rough time estimate.

There are two important steps to complete as soon as you decide you want to make a claim.

Firstly, enquire with a TPD compensation firm like Vilic Law. You can book a free initial consultation with us.

Secondly, run through your existing superannuation policy to find out if you have TPD insurance as part of your policy.

Our lawyers are happy to help you find out if you have a policy.

Unfortunately, our lawyers can only provide generalised advice and predictions around TPD claims and tax.

You will have to speak with an accountant or financial professional to get definitive answers in this space.
