The driver or owner of the car is usually at fault for this and they’re able to make a claim through their insurance. If they do not oblige though, our lawyers can assist you in making a claim.

If you are in an accident caused by car dooring, we recommend reporting the incident to police immediately. This provides you with a little bit of extra protection in the case where you need to make a compensation claim.

The driver is almost always at fault in these scenarios. In Queensland law, drivers have a duty of care to pedestrians — this includes pedestrians who may be on their phones, intoxicated, or crossing the road illegally. 

However, in some cases where it is found that the pedestrian showed some negligence, the sum of compensation may be reduced.

In extremely rare circumstances, the pedestrian can be found to be at fault. Given the level of responsibility the law places on drivers, this is quite rare.
